The person making this posting and submitting this information (the "Submission") in connection with the series Date My Ex: Jo and Slade (the "Series"), acknowledges that he/she is solely responsible for the content, messages and images contained in his/her Submission. Pocket Change is publishing only what has been submitted by the person making the Submission. Pocket Change is hereby granted unconditional, worldwide, royalty free, perpetual and irrevocable permission to use, modify, distribute, display, republish and edit some or all of the content, messages and images submitted by the person making the Submission in any and all media now known or hereafter developed, and the right to grant other entities and third parties the right to use, modify, distribute, display, republish and edit some or all of the content, messages and images submitted by the person making the Submission in any and all media now known or hereafter developed. The person making the Submission grants all of his/her rights to the content, messages, images and other elements contained in the Submission to Pocket Change, its licensees, successors and assigns, including, without limitation, the right to use all or part of the Submission in and in connection with other promotional or publishing materials, in and in connection with any website, and any other use, , exhibition and publication of all or part of the Submission by Pocket Change, its licensees, successors and assigns. The person making the Submission will not be paid for the Submission or for granting Pocket Change any of these rights. Furthermore, Pocket Change is not liable for any inappropriate content posted by users of the Pocket Change site.

The person making the Submission hereby consents to the Submission being exhibited and published, and to the use of his/her name and domicile as provided by him/her, for purposes of advertising, promotion and publicity and otherwise, all without compensation. The decision to post or use any Submission is solely within Pocket Change's discretion, and Pocket Change has no obligation to make any use of any Submission.

The person making the Submission represents and warrants, that: (i) he/she is at least 21 years old; (ii) he/she has the right to submit the Submission and to grant Pocket Change all rights granted under these Terms of Submission; (iii) the Submission is original, truthful and unpublished; (iv) the Submission was created solely by the person making the Submission; (v) the Submission and the use thereof by Pockets Change, its licensees, successors and assigns does not and will not infringe upon any rights of any third party, including but not limited to copyright, trademark, and rights of privacy and publicity; (vi) the Submission does not contain inappropriate or offensive comments, or any libelous, tortious, or otherwise unlawful information; and (vii) the Submission does not violate any federal or state statute or regulation.

The person making the Submission acknowledges that his/her consideration for the rights he/she is granting to Pocket Change in his/her Submission is, among other things, the possibility of Pocket Change’s review or use of the Submission. The person making the Submission will not receive any compensation of any kind for the Submission or for the use of the Submission by Pocket Change, its licensees, successors and assigns.

The person making the Submission assumes all liability for any injury or damages caused or claimed to be caused by the Submission or by the use of the Submission by Pocket Change, its licensees, successors and assigns, and the person making the Submission hereby releases Pocket Change, Bravo Media LLC (“Bravo”), and each of their respective parents, subsidiaries, affiliates, successors, licensees and assigns, and their respective officers, directors, agents, equity holders and employees from any and all claims, actions, damages, losses, liabilities, costs, expenses, injuries or causes of action of any kind whatsoever that in any way are caused by, arise out of or result from any charity auction event in connection with the Series, the Submission, the publication, exhibition or other use or exploitation of the Submission (including, without limitation, the use of the Submission in connection with the Series or in and in connection with advertisements, promotions or publicity), the exhibition and other exploitation of the Series, the posting or streaming of the Submission on the internet and on any website, on any legal theory whatsoever, including, without limitation, a claim for idea misappropriation or defamation.

The person making the Submission understands, acknowledges and agrees that all Submissions are the sole responsibility of the person from whom such Submission(s) originated. This means that the person making the Submission, and not Bravo or Pocket Change, is entirely responsible for the consequences of all Submissions that he/she uploads, posts, transmits or otherwise makes available in connection herewith.

Submissions that are incomplete, illegible or corrupted are void and will not be accepted.

These Terms of Submission shall be governed by, and construed in accordance with, the laws of the state of New York, without giving effect to any choice of law or conflict of law rules (whether of the state of New York, or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the state of New York.
THE PERSON MAKING THE SUBMISSION AGREES THAT IF ANY CONTROVERSY OR CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OF SUBMISSION, THE BREACH OF ANY TERM HEREOF, OR THE PERSON MAKING THE SUBMISSION'S PARTICIPATION IN CONNECTION WITH ANY CHARITY AUCTION EVENT IN CONNECTION WITH THE SERIES CANNOT BE SETTLED THROUGH DIRECT DISCUSSIONS, THE PARTIES SHALL ENDEAVOR FIRST TO SETTLE THE CONTROVERSY OR CLAIM BY MEDIATION CONDUCTED IN THE CITY OF NEW YORK AND ADMINISTERED BY JAMS UNDER ITS APPLICABLE RULES. IF THE CONTROVERSY OR CLAIM IS NOT OTHERWISE RESOLVED THROUGH DIRECT DISCUSSIONS OR MEDIATION, THE PARTIES AGREE THAT IT SHALL THEN BE RESOLVED BY FINAL AND BINDING ARBITRATION
